Man, 39, killed in officer-involved shooting in Bartlett; TBI investigating

Authorities were on the scene Wednesday morning after an officer-involved shooting led to the death of a man on Stage Road near the Bartlett-Memphis border.

The victim's family and authorities identified the man killed as 39-year-old Toby Bailey. They said Bailey barricaded himself in the home Tuesday night.

His family said Bailey recently lost a contract with a janitorial business and had been drinking Tuesday night. 

The Tennessee Bureau of Investigation was called in to investigate the shooting. 

The TBI said in a news release that the shooting occurred  around 1:30 a.m. Wednesday after Bailey refused to come out of the home Tuesday evening. 

“Earlier in the night, officers responded to reports of a domestic violence incident at a home in the 5300 block of Stage Road,” according to the TBI statement. “Upon arriving, a man, identified as Toby Bailey, ran inside his home, made threats to shoot officers, and barricaded himself.”

TBI said a police negotiator, family and a pastor attempted to talk Bailey into surrendering.

He refused and fired several gunshots inside the home, authorities said.

Bartlett SWAT officers deployed tear gas and went into the home around 1:30 a.m. where at least two officers fired when Bailey raised a handgun in their direction, authorities said. Bailey was shot and was pronounced dead on the scene by paramedics.

A third officer shot and killed the family’s rottweiler that was in the home, the TBI said. 

The TBI is called in on fatal officer-involved shootings. Bartlett police officials referred all questions to the state agency. 

The officers involved in the incident were placed on administrative leave with pay pending the outcome of the investigation.

No Bartlett officers were injured in the incident, according to officials.

The shooting occured at a residence in a row of townhouses on the north side of Stage, about a half-mile east of Covington Pike. Authorities appeared to be concentrating on a townhouse on the west side of the duplex at 5300 Stage. A door was open to the residence and law enforcement officals were inside the home.

An upstairs window was open and the blinds inside were bent and broken. It was unclear if the window was significant to the incident.

Below that window, a beige-colored armored MRAP (Mine-Resistant Ambush Protected) vehicle was pulled into the front yard of the duplex.

A TBI truck sat outside at the curb in front of the scene as Bartlett officers blocked two westbound lanes of Stage.

This is the second officer-involved shooting in the Memphis metro area recently.

A Memphis police officer critically wounded 25-year-old Martavious Banks in South Memphis on Sept. 17 during a traffic stop.

Banks remains in the hospital after his family alleges he was shot in the back as he fled from MPD. During the shooting three officers involved turned off their body cameras and in-car cameras during the traffic stop and shooting, police said.
