Demetrius Haley, who was convicted in October of civil rights violations related to Tyre Nichols’ death, has been held in federal custody pending his sentencing on Jan. 22.
The jury handed down its verdict for Tadarrius Bean, Demetrius Haley and Justin Smith on Thursday, Oct. 3, the climax of a nearly four-week federal trial.
Both witnesses said they deleted the Nichols photo. “I didn’t want that in my phone,” said one.
Prosecutors entered two pieces of evidence: the photo of Tyre Nichols and a text-message exchange.
Martin testified that a lieutenant reviewed the footage with him to tell him to “turn your level of aggression off when it’s time to.”
Demetrius Haley’s testimony came amid a tense argument over whether prosecutors should be able to admit as evidence forms that the former police officers filled out after Tyre Nichols’ beating. Related content:
Demetrius Haley asked Thursday, Jan. 18, for the trial to be moved outside of the city due to excessive media coverage of the case, according to court documents filed electronically.

Michael Stengel argued that prosecutors in the federal criminal case against the officers should not be allowed to call upon experts as witnesses to speak about the alleged use of excessive force against Nichols.
The five are defendants in both the criminal and civil cases.

The reasoning for opposing a stay stems from wanting the civil case to keep going and not get bogged down because of the risk to taxpayers.
A lawyer for the officer filed a motion to stay the lawsuit brought by Tyre Nichols’ estate and mother, arguing the proceedings could be prejudicial in the ongoing criminal case.
