Hernandez Govan was requesting a curfew so he could seek employment during the day. Conditions of his initial bond only allowed him to leave house arrest for attorney visits, court appearances and medical visits.
Govan’s attorney, Handel Durham, told Mitchell he told his client to “be on standby” due to “intervening factors” and that Govan was “besieged with a lot of calls.”
“This court feels like that would be too onerous and would delay the trial,” Shelby County Criminal Court Division 10 Jennifer Mitchell said in her verbal ruling.
Suspended Shelby County Criminal Court Division 9 Judge Melissa Boyd’s attorneys say the allegations against her are an “intentional political move.”
Tuesday’s hearing also revealed there may have been a second gun inside the venue.
After the first judge’s recusal from the case, Hernandez Govan appeared in Shelby County Criminal Court Division 10 Judge Jennifer Mitchell’s courtroom for the first time Thursday, Nov. 2.
