This cause came to heard on Petitioner’s Motion for publication and from all proof presented by counsel on behalf of Petitioner, the Court finds as follows:

  1. Petitioner filed a Petition to Partition Jointly Owned Real Property with respect to real property located in Memphis, Shelby County, Tennessee commonly known as 2131 Erie Ave. and O Erie Ave., Memphis, Tennessee.
  2. Petitioner successfully served 1 of the 4 Respondents, as fully appears in the record in this cause.
  3. Despite Petitioners earnest and repeated attempts to deliver a copy of the Petition and Summons to DERRICK SMITH, JIMMIE SMITH, and STACEY SMITH, their whereabouts are unknown.
  4. It appearing to the Court that Petitioners have taken extraordinary measures to locate and serve DERRICK SMITH, JIMMIE SMITH, and STACEY SMITH, all no avail.
  5. The Court finds that Petitioners have gone beyond every reasonable and customary expectation to obtain personal service on DERRICK SMITH, JIMMIE SMITH, and STACEY SMITH.
  6. Petitioner’s Motion for Publication is hereby granted.

IT IS, THEREFORE, ORDERED, ADJUDGED AND DECREED, that Respondents, including DERRICK SMITH, JIMMIE SMITH, and STACEY SMITH, and any Unknown heir; and Any Person Claiming an Interest in Real Property located at 2131 Erie Ave., Memphis, Tennessee and 0 Erie Ave., Memphis, Tennessee may be served by publication to run for four (4) consecutive weeks in a newspaper of general circulation in the city of Memphis, in which the property is located.

IT IS FURTHER, ORDERED, ADJUDGED AND DECREED, that respondents appear at 10:00 a.m. on May 18, 2026 in Division 2 of the Shelby County Probate Court located at 140 Adams, 1st Floor, Memphis, Tennessee 38103 for a hearing on Petitioner’s Petition to Partition Jointly Owned Real Property.
