For tariff refunds, Fred Smith ‘would have personally handed in the papers’ to sue federal government

When Aaron Prather first heard the news of FedEx suing the federal government seeking refunds for various tariffs it had paid in recent weeks, he wasn’t surprised.

FedEx is a business that was built on free trade, so tariffs are its biggest kryptonite, said Prather, a former longtime FedEx employee and now director of robotics and autonomous systems programs at ASTM International.

If any company was going to challenge the federal government as the U.S. Supreme Court ruled some of the Trump administration’s tariffs were illegal, FedEx would be it, Prather said.
