Criminal history has always been considered in setting bail, official says
Shelby County’s Lead Judicial Commissioner John Marshall said the information District Attorney Steve Mulroy vowed to provide is nothing they don’t already have. But a state law that went into effect July 1 will allow them, for the first time, to make public safety the priority when setting bail. “This change in the law will enable the judicial commissioners to set more appropriate bonds on those individuals who threaten the safety of our community,” Marshall said. A new state law making public safety the priority in setting bail will have a far greater impact than Shelby County DA Steve Mulroy’s plan to provide criminal records, which has been done “for decades,” lead judicial commissioner John Marshall says.
