A woman accused of hitting and killing two men with her car in 2022 was captured by U.S. Marshals in Colorado last week and now awaits extradition to Tennessee.

The Sept. 29, 2022, crash instantly killed Elvin Nuñez and critically injured his brother Roberto Nuñez, who died at Regional One Health 42 days later. Prior to the crash, the two were roofing a house on North White Station Road and Sequoia Avenue.

Tracy Totty, 67, was indicted in state court Aug. 4, 2023, for vehicular homicide-intoxication, aggravated vehicular homicide and vehicular homicide-reckless.

Elvin Nuñez was one of 87 pedestrians killed in Shelby County in 2022, according to data from the Tennessee Department of Safety & Homeland Security. There were 60 pedestrian fatalities in 2023 and 21 so far in 2024. (The data counts deaths that occur within 30 days of a crash, meaning Roberto Nuñez would not be included in 2022’s number.)
