Man accused in Campbell Clinic shooting previously charged with attempted murder

The suspect accused in the killing of Dr. Ben Mauck was previously charged with attempted first-degree murder and aggravated assault, according to Shelby County Sheriff’s Office incident reports filed in 2014 and 2016. 

Mauck, an orthopedic surgeon with Campbell Clinic, was fatally shot in an exam room Tuesday, July 11. Larry Pickens, 29, has been charged with first-degree murder and aggravated assault in relation to Mauck’s killing.


Alleged Campbell Clinic shooter prompted police calls last week


The Daily Memphian was able to obtain incident reports that show Pickens was arrested and charged with criminal attempt of first-degree murder on Oct. 31, 2016, and aggravated assault on July 17, 2014. Both incidents involved altercations between Pickens and the same man.

The incident report filed in 2016 said Pickens was arrested and charged with criminal attempt of first-degree murder on Oct. 31, 2016.

According to the report’s narrative, a woman identified as Pickens’ mother called law enforcement to the home Pickens shared with her and her husband on Brionna Street in southeast Shelby County.

Responding officers located a man, identified as Pickens’ mother’s husband, lying on the ground “in agonizing pain” with blood on his clothing and around him.

The narrative said Pickens “aggressively charged” the victim, “striking his upper torso with a knife.” He struck him multiple times in the back before fleeing the house.

An officer found Pickens in the area with blood on his clothing and hands. When the officer got closer to him, they discovered lacerations on his hands.

He was booked in the Shelby County Jail, 201 Poplar Ave., on a criminal attempt of first-degree murder charge.

The victim was transported to Regional One Health in critical condition.

According to the report filed in 2014, Pickens and the same victim, who at the time was identified as Pickens’ mother’s boyfriend, were both arrested after a fight between them. Pickens was charged with aggravated assault in that incident. 

The 2014 report also states that Pickens may have been suffering from a mental illness at the time. However, The Daily Memphian has not independently verified that information.

The records of Pickens’ charges detailed in the incident reports are not available in the Shelby County’s online criminal justice portal. That site offers information on current and previous court records and arrests.

The Daily Memphian obtained the reports from Central Records, 170 N. Main St., and law enforcement sources.

Josh Corman, a former assistant district attorney and current defense attorney, explained the reason why court records may not be available for viewing.

“If the case was dismissed, it can then be expunged from the system,” Corman said in a text. 

Defense attorney Leslie Ballin agreed with Corman and cited Tennessee law, which states, “If the court determines, after hearing, that the person was dismissed and the proceedings against the person discharged, it shall enter the order (to expunge from all official records). The effect of the order is to restore the person, in the contemplation of the law, to the status the person occupied before the arrest or indictment or information.”

Ballin said the law applies to anyone, no matter their charge. 

“If the case is dismissed, it didn’t matter if it was a jaywalking case or a murder case,” Ballin said. “Under the law, that person would be entitled to have the public record expunged.”

Ballin said reasons for the case dismissal can vary and can include jury acquittal, witnesses failing to show up and the state determining it could not carry the burden of proof.
